Terms and Conditions – Club 33 Surf Shop Tamarindo

These Terms & Conditions (“we”, “us”, “our”, “Club 33”) outline the rules for purchasing products, booking surf lessons, renting equipment, participating in events, and using our services online or in-store.

By making a purchase, booking a lesson, or renting equipment, you agree to these Terms & Conditions in accordance with Costa Rican consumer protection laws (Ley 7472 de Promoción de la Competencia y Defensa del Consumidor).

1. Purchases & Returns

1.1 No Returns or Exchanges

Due to the nature of surf products, clothing, accessories, sunscreen and in-store purchases, all sales are final.
We do not accept returns or exchanges unless a product is defective at the moment of purchase, as required by Costa Rican consumer law.

1.2 Shipping

If a customer requests nationwide or international shipping:

  • shipping costs are paid by the customer,

  • Club 33 is not responsible for delays, damage, or loss caused by the carrier,

  • tracking information will be provided when available.

2. Surf Lessons

2.1 Booking & Payments

Lessons must be paid for via cash, card, or SINPE Móvil prior to starting the session.

2.2 Cancellations

  • Cancellations made 24 hours before the lesson may be rescheduled without extra cost.

  • Cancellations made under 24 hours or no-shows are non-refundable.

2.3 Safety Requirements

To participate in a lesson, customers must:

  • follow all instructor directions,

  • be sober (no alcohol, no drugs before or during lessons),

  • disclose any health conditions (e.g., asthma, epilepsy, heart conditions, pregnancy),

  • confirm they can swim safely in ocean conditions.

Failure to follow safety rules may result in removal from the lesson without refund.

2.4 Liability & Insurance

Club 33 ensures safe instruction and provides qualified, experienced instructors.
However, personal insurance is the responsibility of the participant.
By taking a lesson, participants acknowledge that surfing involves inherent risks.

2.5 Children

Children must:

  • be accompanied by a parent/guardian at check-in,

  • be supervised if not actively in a lesson,

  • follow age-appropriate safety rules.

Parents accept responsibility for their child’s behavior and safety outside the lesson.

3. Photos & Media Usage

During surf lessons, surfskate sessions, events, and community activities, we may take photos or videos.

Photos/videos may be used for:

  • sharing directly with the student,

  • marketing purposes (website, social media, printed materials).

We will always request verbal or written consent before publishing identifiable images.

Customers may request:

  • not to appear in any media,

  • removal of posted photos/videos,
    at any time.

4. Equipment Rentals & Ding Repair

4.1 Rental Agreement

Before renting a surfboard or equipment, customers must:

  • show a valid ID (passport, national ID, driver’s license),

  • sign a rental contract acknowledging responsibility for equipment,

  • agree to repair or replacement fees in case of damage, loss, or theft.

4.2 Board Inspection

A staff member and the customer will inspect the board together before rental.
A note or photo of existing condition will be added to the contract.
The customer is responsible for any new damage.

4.3 Safety

Rented equipment must be used responsibly.
Club 33 is not liable for injuries resulting from misuse or unsafe ocean conditions.

5. Payments

We accept:

  • cash (colones or USD),

  • credit/debit card,

  • SINPE Móvil.

All payments must be completed before services are provided or equipment is released.

6. Conduct

We reserve the right to refuse service if a customer:

  • is intoxicated or under the influence,

  • behaves aggressively or disruptively,

  • does not follow safety instructions,

  • refuses to sign mandatory documents (waiver, rental contract).

No refund will be issued if service is denied due to misconduct.

7. Limitation of Liability

By using our services, customers acknowledge:

  • surfing, ocean activities, and equipment use carry inherent risks,

  • Club 33 is not liable for injuries resulting from personal negligence, unexpected ocean conditions, or failure to follow instructions,

  • personal insurance is recommended.

8. Changes to These Terms

We may update these Terms & Conditions at any time.
The latest version will always be posted on this page.

Photo & Video Release Policy

At Club 33 Surf Shop (“we”, “us”, “our”), we respect your privacy and want you to feel comfortable with how photos and videos are taken, used, and stored. This policy explains your rights and how we handle visual content created during surf lessons, board rentals, events, or any Club 33 activity.

1. Purpose of Taking Photos & Videos

We may take photos or videos to:

  • provide surfers with personal images from their session,

  • create marketing and promotional materials (website, Instagram, TikTok, Facebook, print),

  • support educational or training purposes for students and instructors,

  • document community activities, surf days and events.

We always aim to capture positive, respectful, surf-related moments.

2. Consent

2.1 Implicit Consent During Activities

By participating in surf lessons or Club 33 activities, you may appear in general group photos or non-identifiable footage on the beach or in the water.

2.2 Explicit Consent for Marketing

Before posting any identifiable photo or video of you online, we will:

  • request verbal or written consent,

  • confirm via WhatsApp, message, or in person.

We never publish identifiable images without your approval.

3. Your Rights

You may at any time:

  • refuse to be photographed or filmed,

  • request not to appear in any group images,

  • review photos or videos before publication,

  • withdraw previously given consent,

  • request deletion of any photo or video,

  • request that your image never be used for marketing.

To make a request, contact us by WhatsApp or email.
We honor every request—no explanation required.

4. Children & Minors

We take extra care with minors.
We will only photograph or film minors when:

  • a parent or legal guardian is present,

  • explicit consent is provided by the guardian,

  • images are used only for the agreed purpose.

No images of minors will be used for marketing without verbal or written approval.

5. How We Use the Content

With consent, images may appear in:

  • surf lesson promotional posts,

  • galleries, reels, stories or TikToks,

  • instructor training material,

  • website content,

  • surf community features or events.

We do not edit images in a harmful, misleading, or inappropriate manner.

6. Storage & Security

Photos and videos may be stored on:

  • Club 33 devices,

  • encrypted cloud services,

  • professional editing tools.

Media is stored only as long as needed for operational or promotional purposes.
You may request deletion of your content at any time.

7. No Compensation

By giving consent, you acknowledge that:

  • you are not entitled to financial compensation for the use of your image,

  • usage is limited strictly to the purposes discussed or agreed,

  • you may withdraw consent whenever you choose.

If you prefer not to appear in any media, simply inform us.

8. Removal Requests

You may request removal of content from:

  • Instagram posts, reels, or stories,

  • TikTok content,

  • website galleries,

  • any digital or printed marketing material.

Please send us a screenshot or brief description of the media.
We will remove it as quickly as possible.
